Acceptance of Terms & Eligibility

These Terms of Service ("Terms") constitute a legally binding agreement between you and Jumbo Software Ltd, a company registered in England & Wales ("we", "us", "our"), governing your use of the DashCamGo mobile application and related services (the "Service").

By downloading, installing, or using DashCamGo, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

Eligibility Requirements

  • • You must be at least 16 years of age to use DashCamGo
  • • You must have the legal capacity to enter into a binding contract in your jurisdiction
  • • If using on behalf of an organisation, you must have authority to bind that organisation

Service Description

DashCamGo is a mobile dashcam application developed by Jumbo Software Ltd that transforms your smartphone into a dashcam device. The Service includes:

  • Continuous video recording (foreground and background) using your device camera
  • Optional audio recording using your device microphone
  • GPS location tracking with speed overlay (foreground and background during recording)
  • Intelligent crash detection using device accelerometer sensors
  • Loop recording with automatic overwrite of oldest unprotected footage
  • Local device storage of recordings
  • Subscription management via app store in-app purchases

License Grant: We grant you a limited, non-exclusive, non-transferable, revocable licence to use DashCamGo for personal, non-commercial purposes in accordance with these Terms.

User Responsibility

You Are Solely Responsible for How You Use DashCamGo

Jumbo Software Ltd provides a technical tool. You are entirely responsible for ensuring your use of that tool complies with all applicable laws in every jurisdiction where you use it.

Road Safety & Driving Laws

You must comply with all traffic laws, highway codes, and vehicle regulations in your jurisdiction at all times while using DashCamGo.

  • Do not interact with the app while driving. Configure the app before you begin your journey.
  • Mount your device securely so that it does not obstruct your view of the road or mirrors.
  • Background recording is designed so you do not need to touch your phone while driving — use this feature.
  • Comply with local laws on where phones and devices may be positioned in a vehicle.
  • You are responsible for any traffic offences, fines, or accidents arising from your use of the device or app while driving.

Consent & Recording Laws

Recording laws vary significantly by country and region. You are solely responsible for understanding and complying with the recording consent laws applicable in your jurisdiction.

Video Recording

Recording video in public spaces (e.g., roads) is generally lawful in the UK, EU, and most jurisdictions when done incidentally as a dashcam. However, recording on private property or in private spaces may require consent. You are responsible for understanding these distinctions in your location.

Audio Recording

Audio recording consent laws differ widely. In some jurisdictions (including certain US states and EU countries), all parties in a conversation must consent to being recorded. By enabling audio recording in DashCamGo, you accept full legal responsibility for obtaining any required consent from passengers or others who may be recorded. If you are unsure, we recommend disabling audio recording in the app settings.

Jumbo Software Ltd accepts no liability for any legal claims, fines, or penalties arising from your recording activities.

Privacy of Third Parties

Your recordings may capture images of people, vehicles, and private property. You are responsible for handling these recordings in accordance with applicable data protection laws including UK GDPR and EU GDPR.

  • Do not publish, share, or distribute recordings in a way that violates the privacy or dignity of individuals captured
  • Do not use recordings to harass, threaten, or intimidate any person
  • When sharing footage with insurers or authorities, ensure you do so through lawful means
  • If you process third-party footage for commercial or organisational purposes, you may be a data controller under GDPR and must comply accordingly

Dashcam Legality Disclaimer

⚠️ Dashcam use is not legal in all countries or circumstances. It is your responsibility to verify legality before use.

The legality of dashcam recording varies significantly by jurisdiction. Jumbo Software Ltd makes no representation that use of DashCamGo is lawful in your specific location or circumstances.

Countries with Restrictions or Bans

  • 🇦🇹 Austria — Dashcam use is banned (GDPR enforcement)
  • 🇱🇺 Luxembourg — Dashcam use prohibited
  • 🇵🇹 Portugal — Banned for privacy reasons
  • 🇨🇭 Switzerland — Heavily restricted

DashCamGo geo-fences known restricted regions, but this list may not be exhaustive.

  • 🇩🇪 Germany — Legal with restrictions
  • 🇫🇷 France — Legal, GDPR applies
  • 🇺🇸 United States — Varies by state

Laws change frequently — always verify current local regulations.

Jumbo Software Ltd is not liable for any legal penalties, fines, or consequences arising from your use of DashCamGo in any jurisdiction. It is your responsibility to seek independent legal advice if you are unsure about the legality of dashcam use in your location.

Acceptable Use Policy

DashCamGo is designed for lawful personal dashcam use. The following uses are strictly prohibited:

  • Recording, storing, or distributing illegal content of any kind
  • Using the app to surveil, stalk, harass, or intimidate any individual
  • Recording individuals without lawful basis or required consent in your jurisdiction
  • Using footage to commit fraud, blackmail, or other criminal acts
  • Sharing or publishing recordings in ways that violate third parties' privacy or dignity
  • Attempting to reverse-engineer, decompile, or extract source code from the app
  • Using automated systems or bots to access the Service
  • Circumventing geo-fencing, subscription restrictions, or other technical limitations
  • Using the Service for any commercial surveillance or fleet tracking purpose without a separate written agreement
  • Accessing another person's account or recordings without their explicit authorisation

✓ Permitted Uses

  • Personal dashcam recording during your own vehicle journeys
  • Sharing footage with your insurance company or law enforcement to document an incident
  • Storing and reviewing your own journey recordings for personal reference
  • Using GPS and speed data for personal journey documentation
We reserve the right to suspend or terminate your account if we reasonably believe you have violated this Acceptable Use Policy, without prior notice and without refund.

Subscription Terms

  • Free Trial: New users receive a 7-day free trial. You will not be charged until the trial ends.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
  • Cancellation: Cancel anytime through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
  • Refunds: All payments are processed by Apple or Google. Refunds are subject to their respective refund policies. We do not process refunds directly.
  • Price Changes: We will notify you of any price changes at least 30 days in advance.

Your Recordings & Content Ownership

You own your recordings. Jumbo Software Ltd claims no ownership over the video, audio, or GPS data you record using DashCamGo. All recordings are stored locally on your device only.

You remain solely responsible for the content of your recordings, including ensuring they do not contain illegal content and that they are used in accordance with applicable laws.

Limitation of Liability

Please Read This Section Carefully

This section significantly limits Jumbo Software Ltd's legal liability to you. It is an important part of the agreement between us.

Service Provided "As Is"

DashCamGo is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Jumbo Software Ltd disclaims all warranties including but not limited to:

  • That the app will capture every incident or record continuously without interruption
  • That crash detection will trigger in every crash or impact scenario
  • That recordings will be admissible as evidence in any legal or insurance proceeding
  • That the app will function correctly on all devices or operating system versions
  • That GPS data will be accurate in all locations and conditions

Excluded Liability

To the maximum extent permitted by applicable law, Jumbo Software Ltd shall not be liable for:

  • Any road traffic accident, injury, death, or property damage — whether or not the app was in use at the time
  • Failure to record an incident due to app crash, device failure, storage limitations, or any other reason
  • Any legal penalty, fine, or claim arising from your dashcam use in any jurisdiction
  • Loss or corruption of recordings stored locally on your device
  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of income, profit, data, goodwill, or opportunity
  • Third-party claims arising from your use of recordings

Liability Cap

Where liability cannot be fully excluded by law, Jumbo Software Ltd's total aggregate liability to you in respect of any claim shall not exceed the greater of: (a) the total amount you paid for the Service in the 12 months preceding the claim, or (b) £50 GBP.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Jumbo Software Ltd, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with: (a) your use of DashCamGo; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your recordings and how you use, share, or distribute them.

Licensed Application End User License Agreement (Apple)

Apps made available through the App Store are licensed, not sold, to you. Your license to each App is subject to your prior acceptance of either this Licensed Application End User License Agreement ("Standard EULA"), or a custom end user license agreement between you and the Application Provider ("Custom EULA"), if one is provided. Your license to any Apple App under this Standard EULA or Custom EULA is granted by Apple, and your license to any Third Party App under this Standard EULA or Custom EULA is granted by the Application Provider of that Third Party App. Any App that is subject to this Standard EULA is referred to herein as the "Licensed Application." The Application Provider or Apple as applicable ("Licensor") reserves all rights in and to the Licensed Application not expressly granted to you under this Standard EULA.

a. Scope of License

Licensor grants to you a nontransferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules. The terms of this Standard EULA will govern any content, materials, or services accessible from or purchased within the Licensed Application as well as upgrades provided by Licensor that replace or supplement the original Licensed Application, unless such upgrade is accompanied by a Custom EULA. Except as provided in the Usage Rules, you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute or sublicense the Licensed Application and, if you sell your Apple Device to a third party, you must remove the Licensed Application from the Apple Device before doing so. You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Licensed Application).

b. Consent to Use of Data

You agree that Licensor may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

c. Termination

This Standard EULA is effective until terminated by you or Licensor. Your rights under this Standard EULA will terminate automatically if you fail to comply with any of its terms.

d. External Services

The Licensed Application may enable access to Licensor's and/or third-party services and websites (collectively and individually, "External Services"). You agree to use the External Services at your sole risk. Licensor is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by any Licensed Application or External Service, including but not limited to financial, medical and location information, is for general informational purposes only and is not guaranteed by Licensor or its agents. You will not use the External Services in any manner that is inconsistent with the terms of this Standard EULA or that infringes the intellectual property rights of Licensor or any third party. You agree not to use the External Services to harass, abuse, stalk, threaten or defame any person or entity, and that Licensor is not responsible for any such use. External Services may not be available in all languages or in your Home Country, and may not be appropriate or available for use in any particular location. To the extent you choose to use such External Services, you are solely responsible for compliance with any applicable laws. Licensor reserves the right to change, suspend, remove, disable or impose access restrictions or limits on any External Services at any time without notice or liability to you.

e. NO WARRANTY

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

f. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall Licensor's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

g. Export Restrictions

You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, the Licensed Application may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the Licensed Application, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.

h. U.S. Government End Users

The Licensed Application and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. i. Governing Law (Apple EULA)

Except to the extent expressly provided in the following paragraph, this Agreement and the relationship between you and Apple shall be governed by the laws of the State of California, excluding its conflicts of law provisions. You and Apple agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, to resolve any dispute or claim arising from this Agreement. If (a) you are not a U.S. citizen; (b) you do not reside in the U.S.; (c) you are not accessing the Service from the U.S.; and (d) you are a citizen of one of the countries identified below, you hereby agree that any dispute or claim arising from this Agreement shall be governed by the applicable law set forth below, without regard to any conflict of law provisions, and you hereby irrevocably submit to the non-exclusive jurisdiction of the courts located in the state, province or country identified below whose law governs:

If you are a citizen of any European Union country or Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.

Specifically excluded from application to this Agreement is that law known as the United Nations Convention on the International Sale of Goods.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of DashCamGo shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in another EU/EEA member state, you may also have the right to bring proceedings in the courts of your country of residence, and you retain the benefit of any mandatory consumer protection laws in your jurisdiction.

Before initiating legal proceedings, we encourage you to contact us at support@dashcamgo.app so we can attempt to resolve the dispute informally.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before they take effect. Your continued use of DashCamGo after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
